Terms of use

PainelObra is a site management service for construction companies: daily reports, photos, snags, costs, measurement sheets, time tracking, fleet and team. It works on the phone and on the computer, with the same data on both.

The service is provided by the party identified under Who we are at the end of this page, hereinafter “we”. If you create the account on behalf of a company, you confirm that you are authorised to bind it to these terms.

To use the service you need an account with a valid email address. You are responsible for keeping your password secret and for everything done with your account.

You must be at least 16 years old, or the minimum working age in your country if higher. The service is intended for professional use, not for consumers.

If you become aware of misuse of your account, let us know as soon as possible.

Accounts are organised into companies. Whoever creates the company is its owner; they can promote other people to manager, and everyone else joins as a worker.

Roles decide access, and that decision is enforced on the server, not only on the screen:

• Owners and managers see the company's sites, costs, budgets, measurement sheets, hourly rates and timesheets.
• Workers see their own day and the sites they are assigned to. They do not see money — no budgets, no costs, no measurement sheets, no one's hourly rate.
• Only the owner sees the company's audit log.

Joining a team requires a company code and approval from its management. You can leave a company at any time under Privacy and data.

There is a free plan and a paid plan. The free plan allows one active site, three people on the team, thirty reports per month and two photos per set; it does not include time tracking, costs, measurement sheets, fleet, the client portal, the audit log or the company letterhead on printed reports.

The paid plan is billed monthly, per company, at the price shown on the plans page at the time of subscription. Prices are shown in euros or in reais depending on the account's country. Prices in euros already include VAT.

We may change prices. A change never applies to a period already paid and is announced at least 30 days in advance; if you do not agree, you can cancel before it takes effect.

We may also adjust the free plan's limits, with the same notice. Existing data is never deleted because of that.

The subscription renews automatically at the end of each period. You can cancel whenever you like on the Billing page; cancellation takes effect at the end of the period already paid and, until then, the service stays the same.

When a subscription ends or goes unpaid, the company moves to the free plan. Nothing is deleted: what was created in the paid sections remains visible, read-only, and can be exported.

Payments are processed by Stripe; we do not store your card number. Invoices are issued electronically and are available on the Billing page.

You are entitled to a full refund within 14 days of the first charge of a paid subscription, with no need to give a reason.

To request a refund, contact us by email within those 14 days; we return the amount to the original payment method. After that period, renewals are not refundable, but you can cancel at any time to avoid future charges.

The sites, reports, photos, measurement sheets, costs and everything else your team writes or uploads to PainelObra remain yours. We do not sell it, use it for advertising or use it to train artificial intelligence models.

You only give us the permission strictly needed to operate the service: to store, process and show that content to the people you have given access to.

You are responsible for what you upload: make sure you have the right to do so and that you have informed the people whose data you record — workers and clients.

You can export everything at any time, in an open format, on the Privacy and data page. Measurement sheets always remain available in the Excel format they were uploaded in.

When your company records data about workers or clients in PainelObra, it is the controller of that data and we are its processor. This section constitutes the contract required by article 28 of the GDPR and, in Brazil, defines our role as operator under the LGPD. We undertake to:

• process that data only to provide the service and according to the company's instructions, which are those resulting from its use of the service;
• ensure that anyone with access to it is bound by confidentiality;
• apply the security measures described in the Privacy policy;
• use only the providers listed in the Privacy policy, giving notice before adding or replacing any of them so that the company can object;
• help the company respond to requests from data subjects and meet its own obligations;
• inform the company without undue delay if we become aware of a data breach affecting it;
• at the end of the contract, delete that data — the company can export it beforehand — unless the law requires us to keep it;
• make available the information needed to demonstrate compliance with these obligations.

You may not use the service for illegal activities, upload content you have no right to upload, try to access other companies' data, circumvent plan limits or overload the infrastructure through automated means.

Nor may you use time tracking to monitor people outside working hours — see the Privacy policy.

We do our best to keep the service available, but we do not guarantee uninterrupted operation: there is maintenance, there are third-party outages and there are sites without signal. The mobile app works offline and syncs when there is a connection.

We protect data with the measures described in the Privacy policy, but no system is free of failures: keep periodic exports of whatever is critical to you.

We may improve the service and add or remove features. If we remove a paid feature you depend on, we give reasonable notice.

Support is provided by email, on business days.

You can delete your account whenever you like under Privacy and data. If you own a company with other active members, you must first remove them or transfer the company.

We may suspend or close an account that breaches these terms or whose activity puts the service or third parties at risk. Whenever reasonable, we warn you first and give you a chance to fix it.

After termination, data is handled as described in the Privacy policy.

The software, design, the PainelObra brand and the website's content belong to us or our licensors. While your account exists, you have a personal, non-exclusive and non-transferable licence to use the service under these terms.

You may not copy, decompile, resell or build derivative services from PainelObra. Suggestions you send us may be used to improve the service, with no obligation to pay for them.

The service is provided as is. We do not guarantee that it is fit for a particular purpose or free of errors.

To the fullest extent permitted by law, our total liability to you, for any reason, is limited to the amount you paid us in the twelve months before the event that gave rise to it. We are not liable for lost profits or indirect damages.

Nothing in these terms excludes liability that the law does not allow to be excluded, including for wilful misconduct or for harm to life and physical integrity.

We may change these terms. When a change is significant, we give at least 30 days' notice by email or within the app.

If you do not agree with the new version, you can cancel before it takes effect.

If any clause of these terms is found invalid, the rest remain in force. Not exercising a right at a given moment does not mean waiving it.

You may not transfer your position under these terms without our agreement; we may do so as part of a reorganisation or sale of the business, with notice to you.

Communications with you are sent to the account's email address or within the app.

These terms exist in several languages. In case of discrepancy, the European Portuguese version prevails.

These terms are governed by Portuguese law. The courts of the district of Lisbon, Portugal, have jurisdiction over any dispute, without prejudice to mandatory rules that protect you in another country.

If you use the service from Brazil, mandatory Brazilian rules also apply, in particular the General Data Protection Law (LGPD).
